1. Acceptance of Terms

By accessing or using the TenantSheet platform ("Service"), operated by Andrew Nguyen, an individual doing business as TenantSheet ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

TenantSheet is a cloud-based property management platform that enables real estate professionals to manage properties, units, leases, tenants, rent payments, maintenance requests, expenses, and related operations. The Service includes a management dashboard for property managers and a tenant portal for residents.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access to your account
  • Ensuring your account information remains accurate and up to date

You must be at least 18 years old to create an account. By registering, you represent that you meet this age requirement.

4. Subscription & Billing

The Service offers subscription plans with varying features and limits. Key billing terms:

  • Free Trial: New accounts receive a 30-day free trial. The trial period begins when you create your first organization and is tied to your user account (not individual organizations).
  • Billing: After the trial period, each organization requires an active paid subscription. Payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
  • Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods unless otherwise stated.
  • Price Changes: We may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing cycle.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Upload or transmit malicious software, viruses, or harmful code
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use the Service for any purpose other than property management operations
  • Store or transmit content that is unlawful, defamatory, or infringes intellectual property rights

6. Data Ownership

You retain all ownership rights to the data you submit to the Service, including property information, tenant records, financial data, and documents ("Your Data"). We do not claim ownership of Your Data.

You grant us a limited license to use, store, and process Your Data solely to provide and improve the Service. We will not sell, rent, or share Your Data with third parties except as described in our Privacy Policy or as required by law.

You may export or delete Your Data at any time. Upon account termination, we will retain Your Data for 30 days to allow for recovery, after which it will be permanently deleted.

7. Payment Processing

The Service facilitates rent payments between property managers and tenants through Stripe. Regarding payment processing:

  • We are not a party to the landlord-tenant financial relationship
  • Payment processing is provided by Stripe and is subject to Stripe's terms of service
  • A platform fee may apply to processed rent payments
  • We are not responsible for payment disputes between landlords and tenants

8. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your account if:

  • You violate these Terms
  • Your subscription payment fails and is not resolved within a reasonable period
  • We are required to do so by law
  • We discontinue the Service (with reasonable notice)

Upon termination, your right to access the Service ceases immediately. Sections regarding data ownership, limitation of liability, and governing law survive termination.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy or completeness of any information provided through the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TENANTSHEET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or alteration of your data
  • Any third-party conduct on the Service
  • Any other matter relating to the Service

Our total liability for any claims arising from or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Colorado.
